1. SWEEPSTAKES PERIOD: The “Sweepstakes” begins at [12:00 a.m. Eastern Time (“ET”) on March 28, 2023] and ends at [11:59 p.m. ET on April 7, 2023] (“Sweepstakes Period”).

2. ELIGIBILITY: The Sweepstakes is open only to individuals, twenty-one (21) years or older at time of entry. Employees of Divi & Tamarijn Aruba All Inclusives and its parent companies, subsidiaries or agents, their immediate families (defined as parents, children, siblings, spouse and grandparents), and those domiciled with any of the foregoing are not eligible.

3. HOW TO ENTER:  NO PURCHASE OF ANY KIND IS NECESSARY TO ENTER OR WIN.  A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.

During the Sweepstakes Period, fill out the form on our contest page. All information provided by entrant must be complete, true and correct. Submissions to the Sweepstakes must be received by April 7, 2023 in order to be eligible; entries received after the deadline will be deemed ineligible to win. By entering, you agree to be bound by these Official Rules.

4. TRANSFER OF RIGHTS: By completing actions for Entries, entrants and winners acknowledge and agree that their Entries (including social media accounts and all information submitted as part of the Entries) become the property of the Sponsor, which thereby has the right to edit, adapt, modify, reproduce, promote and otherwise use Entries in any way it sees fit.

5. RANDOM DRAWING: One (1) Grand Prize will be awarded in a random drawing on or about April 10, 2023 from all eligible Entries received throughout the Sweepstakes Period. The random drawing will be conducted by the Administrator, an independent judging organization whose decisions are final on all matters relating to the Sweepstakes. Odds of winning a prize depend upon the total number of eligible Entries received. Potential winners will be notified by email on or before April 10, 2023.  Winner must agree to the specific terms and travel schedule of the prize as outlined below and provide ID for verification of minimum required age of 21 years or older.

6. GRAND PRIZES: One (1) Grand Prize:

A 7-night all inclusive stay for two (2) adults in one (1) Premium Oceanfront room at Tamarijn Aruba All Inclusive. Prize is limited to two (2) adults only. 

Winner’s must select one set of travel dates: May 14-21, 2023 or May 15 – 22, 2023 or May 16 – 23, 2023.

Winners must participate in specific social events held at the Hi-Winds competition beginning May 17, 2023.  

Winners are expected to be photographed with Hi-Winds staff and competitors and consent to usage of photography on resorts social media and websites. Winners will also be required to sign photo and video release & agree to film production schedule at hotel and at event.

Winners are required to provide their own air transportation to and from Aruba. Prize includes all inclusive hotel accommodations – including all meals and snacks, beverages (alcoholic and non-alcoholic) on property as well as all hotel taxes and service charges. Round trip transportation to and from Aruba airport as well as offsite Hi-Wind’s event venue(s) are included. Any applicable fees, taxes and charges are not included and other rules and restrictions may apply. Travel must occur over the specific dates selected between May 14 through May 23, 2023, with no exceptions.  The trip is nontransferable, non-assignable, non-refundable, non-combinable with any other special prizes or offers, not redeemable for cash and must be redeemed in its entirety (no portion of a prize may be redeemed separately). No changes will be allowed after any elements of the prize have been awarded and no substitution may be made.

Winners will be notified by direct message on social media or email. No prize substitution or transfer is permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value (including cash, at Sponsor’s sole discretion) for any reason.  Return of any prize notification as undeliverable may result in disqualification and alternate selection. Taxes related to the prizes are the responsibility of the winners. No responsibility or liability is assumed for damages, losses or injury resulting from acceptance or use of any prize. All other expenses and costs not expressly listed above are each winner's sole responsibility.

All federal, state and local laws and regulations apply; void where prohibited. PRIZES MAY BE SUBJECT TO TAX; ALL APPLICABLE TAXES ARE THE RESPONSIBILITY OF THE WINNER.  

7. GENERAL RULES: In the event of a dispute regarding any Entry, that Entry will be deemed made by the authorized account holder of the email address associated with the account where entering or submitted at the time of the submission. Potential winners may be required to show proof of being the authorized account holder of the email address associated with the Entry. By participating in this Sweepstakes, entrants agree to be bound by the Official Rules and the decisions of the Sponsor/Administrator. The Sponsor and its agencies are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in this Sweepstakes or by any human error which may occur in the processing of the Entries in this Sweepstakes. The Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the Entry process or the operation of the Sweepstakes or the Website; violates these official rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. The Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes if it is not capable of running as planned, including, but not limited to, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures or any other problems beyond the control of the Sponsor and award the prizes from among all eligible Entries received prior to cancellation. The Sponsor and each of its respective affiliates, officers, directors, agents, employees, Facebook and Twitter will have no liability or responsibility for any claim arising in connection with participation in this Sweepstakes or the prizes awarded. Winners assume all liability for any injury or damage caused, or claimed to be caused, by participation in this Sweepstakes or use or redemption of a prize.

8. RELEASE: By participating in the Sweepstakes, you hereby grant the Sponsor, its affiliates, subsidiaries, assigns, licensees, and legal representatives an exclusive, irrevocable, royalty-free, worldwide license to use, reproduce, edit, market, store, distribute, have distributed, publicly and privately display, communicate, publicly and privately perform, transmit, have transmitted, create derivative works based upon, promote the Entry (as such may be edited and modified by the Sponsor in its sole discretion) for editorial, commercial, promotional and all other purposes. For the avoidance of doubt, entrant shall have no rights to reproduce, use or create derivative works from Entry in any way.  You waive any right to inspect or approve uses of the Entry. You hereby represent and warrant that you have read these rules and are fully familiar with its contents.

9. GENERAL TERMS By participating in the Sweepstakes, each entrant fully and unconditionally agrees to be bound by and accepts these Official Rules and the decisions of Sponsor (including, without limitation, decisions regarding eligibility of entries, the selection of entrants and the winner, and the awarding of any prize), which are final and binding in all respects. Entry and acceptance of a prize constitute permission to use each winner’s name, prize won, hometown and likeness for print publication, online posting, and any other promotional purposes without further compensation, except where prohibited by law. By participating in the Sweepstakes, you agree to release Sponsor and its parent companies, affiliates, subsidiaries, employees, directors, officers, and agents from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the receipt, ownership, possession, use, or misuse of any prize. Sponsor is not responsible for technical, hardware or software failures, or other errors or problems which may occur in connection with the Sweepstakes, whether computer, network, technical, mechanical, typographical, printing, human or otherwise, including, without limitation, errors or problems which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes, in any Sweepstakes-related materials, or that may limit prize fulfillment or a participant’s ability to enter the Sweepstakes. Sponsor reserves the right to amend these Official Rules. Sponsor reserves the right, in its sole discretion, to terminate, modify or suspend the Sweepstakes if, in Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if viruses, bugs, unauthorized intervention, fraud, technical difficulties or failures or any other factor beyond Sponsor’s reasonable control corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes. In such event, Sponsor reserves the right (but does not have the obligation) in its sole discretion to award prizes at random from among eligible, non-suspect entries received up to the time of suspected impairment. Sponsor may permanently disqualify from the Sweepstakes any person it believes has tampered with the entry process or intentionally violated these official rules.  

10. DISPUTES: By entering the Sweepstakes, Entrants agree that 1.) Any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action; 2.) Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes but in no event attorneys' fees; and 3.) Under no circumstances will any Entrant be permitted to obtain any award for, and Entrant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

11. PRIVACY POLICY: Information collected by Sponsor in connection with this Sweepstakes may be used by Sponsor and shared with third parties involved in administration of the Sweepstakes in accordance with the online Privacy Policy posted at https://www.diviandtamarijnaruba.com/privacy-policy.htm. The entrant agrees to the collection, processing and storage of his/her personal data by Sponsor for the purposes of the Sweepstakes.
